


Services related to the Emergency Medical Treatment and Labor Act (EMTALA) include:
- Provide EMTALA Education
- Onsite or webinar presentations on EMTALA for hospital leadership, emergency department physicians and nurses, or hospital ED on-call physicians.
- Onsite or webinar EMTALA presentations for hospital associations, medical societies, state bar associations, physician or nursing service providers.
- Review EMTALA compliance/assess risk of specific hospital, ED, or physician services
- Hospital administrative and medical staff leadership duties under the law
- Emergency department issues
- Labor and delivery department issues
- On-call physician issues
- EMTALA’s mandate to accept transfers from other hospitals
- Psychiatric services issues
- Policies and procedures review
- Peer review of EMTALA compliance for individual patient encounters
- Assist hospital counsel in defending against civil litigation claims under EMTALA
- Case review and/or consulting expert
- Expert witness affidavit or testimony
- Write briefs, motions for summary judgment, or appeals
- Deal with CMS or OIG enforcement of EMTALA
- Help write the plan of correction to address CMS’s statement of EMTALA deficiencies to avoid termination from Medicare.
- Assist/represent hospitals or physicians at Quality Improvement Organization (QIO) hearings regarding alleged EMTALA violations.
- Assist/represent hospitals or physicians if the OIG attempts to assess a civil monetary penalty or terminate a physician from Medicare.
- Support National or State Hospital or Physician Associations in addressing specific EMTALA issues or concerns with the appropriate governmental entities.
